Overreach by Special Taxing Districts

Recently, Munger, Chadwick & Denker represented more than fifty homeowners against Cochise County, when the County attempted to impose a new property tax to pay for a golf course. The County attempted to create a new taxing district by calling the golf course a “community park,” and then attempted to obtain signatures from “more than one-half of property owners” to support the new tax.
Munger, Chadwick & Denker succeeded in overturning the new taxing district because the County, among other mistakes, refused to accept that each “property owner” only got one vote, no matter how many lots were owned by that owner (and thus that the private owners of the golf course itself – who owned multiple lots – only had one vote, rather than multiple votes). Not only did Munger, Chadwick & Denker succeed in freeing its clients from this new tax, but it also obtained repayment of attorneys’ fees from the County in excess of the statutory maximum because this was an issue of state-wide concern.
